This form is used solely for the purposes of processing your claim for compensation, Cornwall Council does not accept this form as a notification of defect. To notify us of a defect on the highway, you must telephone 0300 1234 222.
Please provide as much information as possible so that we can investigate your
claim fully and fairly.
What you need to include
To prevent a delay in processing your claim please have ready to upload;
- The reference number of the reported defect - this will start with a W or a M
- Map marking the location
- Photographs of the defect and surrounding areas (if available)
- Photographs of the damage (if available)
- Independent estimates of the damage repair
Cornwall Council has a responsibility to its Council tax payers to ensure that all claims are assessed individually and fairly; Where the Council could be held legally liable compensation will be arranged in a timely manner.
The Council and its insurers have an anti-fraud system in place to assist them in detecting dishonest claims and taking appropriate action.
Please note: Claims without precise location information, date and time of incident cannot be investigated. Please enclose photos of the damage incurred and the defect where possible.
The information supplied to us may be held on a computer database and passed to
our insurers.
This authority is required by law to protect the public funds it administers and to
this end may use the information you have provided for the prevention and
detection of fraud.
It may share the information with other bodies responsible for auditing or administering public funds for these purposes.
The Cabinet Office requires us to participate in data matching exercises to assist
in the prevention and detection of fraud.
We are required to provide particular sets of data to the Minister for the Cabinet Office for matching for each exercise, which includes Insurance Claim data. The use of the data by the Cabinet Office is carried out with statutory authority under Part 6 of the Local Audit and Accountability Act 2014. It does not require the consent of the individuals concerned under the Data Protection Act 1998.
