Advice for householders about Advance Payment Code notices


A land search will be carried out as part of the process of buying a house. If an Advance Payments Code (APC) notice is registered against the property it will be listed within Part 4, miscellaneous charges.

An Advance Payments Code (APC) Notice is a statutory notice served by Cornwall Council. The Local Land Charges register will show all notices, payments and refunds.

The APC is a sum of money secured with us for the construction of the roads. It protects property owners if the developer does not finish the streets.

The notice includes a plan showing which streets the APC sum applies to.  Payments will remain secured until an appropriate exemption applies.

APC's will be served on roads that meet our adoption criteria but this does not mean they will be adopted.

Owners / prospective owners should make sure that:

  • they know what maintenance provisions are in place if the road is not adopted, and
  • who will be responsible for funding this

If the road has not been adopted and

  • an APC notice has not been served, or
  • an exemption certificate has been issued

The owners or management company will be responsible for the maintenance of the road.

Private Street Works Code

The Private Street Works Code enables the us to carry out works on private streets.

We will use any APC money secured for the development towards the cost of any works.

Where the APC sum is not secured, or insufficient the affected property owners will be liable for any costs above the APC amount held. This is set out in sections 205 – 218 of the Highways Act 1980.

We do not as a matter of course use our Private Street Works powers.
